New Client Application

Industrial Personnel, Inc. (hereinafter called Personnel) does hereby agree with the Client named on the Client Credit Application (hereinafter called Client) as follows:

1. Personnel agrees that the services for which the invoice is rendered have been performed and all future services by Personnel for the Client during the term of this contract shall be performed by the employees of Personnel in an acceptable, workmanlike manner and Personnel assumes all legal responsibilities as the employer of said persons, including payment of all wages and other compensation due to said persons and including compliance with all applicable federal state and other payroll tax requirements. Upon request of the Client, Personnel will furnish to the Client evidence of compliance. Client acknowledges and agrees that the persons assigned by Personnel are the employees of Personnel and not the employees of Client.
2. The Client shall endeavor to provide a suitable place for Personnel employees to work in the performance of the services rendered, which place shall comply with all applicable federal and state statutes and municipal ordinances relating to health and safety and also with the general standards of health and safety maintained by the Client for its own Personnel, including the standards imposed by the Occupational Safety and Health Act of 1970.
3. Absent prior specific written agreement from Personnel, Personnel does not assume liability for bodily injury, property damage, fire, theft or collision claims arising out of the use of Client's machinery, equipment, material or automotive equipment, whether owned or rented, while in the care, custody or control of Personnel, its agents or employees. Client agrees that it will not, without prior written consent of Personnel, utilize Personnel employees to operate machinery, equipment or vehicles not covered by Client's liability and property damage insurance, or to operate dangerous or unprotected machinery.
4. Client acknowledges that Personnel's insurance does not cover claims of Personnel's employees for damages of, loss of, or loss of use of Client's owned, non-owned or leased vehicles, machinery, equipment or material while being used by or in the care, custody or control of Personnel's employees, and that Personnel does not assume liability for the claims of Personnel employees damage to, loss of, or loss of use of Client's owned, non-owned or leased vehicles, machinery, equipment or materials while being used by or in the care, custody or control of the Personnel employees.
5. Personnel shall procure and maintain Workman's Compensation and Employers Liability Insurance as required by state law and upon request shall provide the Client with a certificate of said insurance.
6. Personnel agrees to indemnify and save harmless the Client against any liability for premiums, contributions or taxes payable under the Workman's Compensation, Unemployment Compensation, Disability Benefit, or Tax Withheld which the Client shall be finally adjudged liable as an employer with respect to any employee of Personnel assigned by Personnel in the performance of work for the Client but Personnel shall not be obligated to insure this risk.
7. Client agrees to employ employee for a minimum of 90 consecutive days (excluding weekends) through Personnel prior to permanent employment with said Client's company.
8. If Client does not abide by the above 90-day policy the penalty will be the current hourly bill rate times 8 hours times the number of remaining days.
9. Client agrees that Personnel employees in service will be utilized only in work classified in Job Description on time ticket.
10. Client agrees that it will not entrust Personnel employees with unattended premises, cash negotiable or valuables.
11. Client agrees to payment terms as due upon receipt with a grace period of up to 30 days from the date of invoice.
12. Client agrees to a 4-hour minimum per man for satisfactory work only. Unsatisfactory workers may be replaced at no charge within the first 2 hours of work.
13. Client will be charged time and a half for any employee who works 40 hours or more in any week, Monday–Sunday.
14. Client agrees to pay 2 hours show-up time if cancellation of order is not done 1 hour prior to start time.
15. Client shall not utilize Personnel employee under or above ground in excess of 2 feet without prior consent.
